Questions Commonly Asked by Our Personal Injury Clients

What is the Personal Injury Claim Process?

We usually approach the other side for settlement or attempt mediation after your medical treatment has concluded. If an agreement can be reached through this process, we collect payment and the case ends.

If your case can't be settled, a personal injury trial begins when we file a summons and complaint in the appropriate Virginia court. Our office is in Norfolk, Virginia so we often file suit there, but we serve seven cities in Hampton Roads, so the case may be opened in Chesapeake, Virginia Beach, Suffolk, Hampton, Newport News, or Portsmouth.

After filing your case, we serve the Defendant a copy of the documents, including your complaint and everything that you need for recovery.

Will my Personal Injury Case go to Trial?

Most personal injury cases do not go to trial, usually resolving by settlement. A case is most likely to go to trial when the facts are in dispute, when there is a contested legal issue, or when we feel like a better result can be reached by a judge or jury.

The more carefully we build your case and present your evidence, the more likely we are to reach an appropriate settlement. If your case is in the minority of cases that go to trial, the Zedd legal team will prepare you for what to expect.

How Much is my Personal Injury Case Worth?

There is no way to calculate the exact value of your claim, but we can estimate your damages by considering your costs for medical treatment, lost wages, general pain and suffering and other expenses that we will compile when building your case. Call to set-up your free consultation for further details.

How Long Does a Personal Injury Lawsuit Take?

This depends on the extent of your medical treatment.

The shortest cases resolve in a few weeks without any formal litigation. In other cases, litigation can continue for a year or more. Most cases fall somewhere in the middle. The more complicated your case, the longer you can expect it to take. You have some control over the length of your case because it is up to you to accept or reject settlement offers.

How long do I have to file a personal injury claim?

For most personal injury cases, the statute of limitations is two years. You have until one day before the period of limitation expires to file, but we recommend doing so well in advance.
