What is the Personal Injury Claim Process?

We usually approach the other side for settlement or attempt mediation after your medical treatment has concluded. If an agreement can be reached through this process, we collect payment and the case ends.

If your case can't be settled, a personal injury trial begins when we file a summons and complaint in the appropriate Virginia court. Our office is in Norfolk, Virginia so we often file suit there, but we serve seven cities in Hampton Roads, so the case may be opened in Chesapeake, Virginia Beach, Suffolk, Hampton, Newport News, or Portsmouth.

After filing your case, we serve the Defendant a copy of the documents, including your complaint and everything that you need for recovery.


Will my Personal Injury Case go to Trial?

Most personal injury cases do not go to trial, usually resolving by settlement. A case is most likely to go to trial when the facts are in dispute, when there is a contested legal issue, or when we feel like a better result can be reached by a judge or jury.

How long do I have to file a personal injury claim?

For most personal injury cases, the statute of limitations is two years. You have until one day before the period of limitation expires to file, but we recommend doing so well in advance.
